Are you receiving the pay and other benefits you're entitled to?

U.S. visa and visa-waiver programs guarantee workers critical benefits and protections. These benefits include fair wages, overtime pay, reimbursement for travel expenses, and more. Unfortunately, some employers fail to provide these benefits.

Answer the questions below to find out whether you’re being treated fairly and what to do if your employer isn’t following the rules.

1. Are you working in the United States under a visa program or the visa-waiver program?

Which Visa program is it?

2. How long do you expect to be in the United States?

3. Are you being paid at least the federal and state minimum wages?

4. Are you being paid the same hourly wage as American citizens who are performing the same or similar jobs?

5. Does the company you work for provide health or retirement benefits to its American workers?

Do you also receive health or retirement benefits?

6. If you are working under an H-2B visa, did the company you work for pay or reimburse you for the cost of traveling from your home country to the city/town of the work site?

7. If you work more than 40 hours a week, are you paid a higher hourly rate for the additional hours?

8. How are you paid?

9. Have you been asked to perform tasks that don’t fit your job description?

10. If you are an H-2B visa worker, you should check whether your employer actually holds H-2B visas. Sometimes recruiters falsely claim a company will apply for and receive H-2B visas for workers. Check for the name of the company you work for in the “recruiter entity” column of the spreadsheet here. Is your employer listed?
